Ebayer is using a picture of my car....legal recourse?

I found an Ebay seller using pictures he probably took of my clic BMW at a car show last year. He is selling a "fake" body kit that is similar to the one I have on my car. It is a blatant misrepresentaion. My car is pretty well know in the BMW community and I'm getting emails asking if my kit is fake now! I spent thousands of dollars importing the kit from Germany years ago. I have emailed the seller but he has not responded. Ebay is stringing me along giving me burden of proof. I heard I have no legal recourse since the pictures are not my intellectual property. Basically he can do whatever he wants unless it's harming me financially or physically.
